Si somos propietario de un piso puesto en alquiler, el mayor temor será siempre encontrarnos con un usuario moroso o que realice daños intencionales a nuestra propiedad. Si esto ocurriera y tenemos un piso de alquiler con morosos, existen diversos mecanismos conciliatorios, legales y judiciales a los que podríamos apelar para intentar resolver la deuda, la indemnización por la pérdida del patrimonio y principalmente el desalojo del inquilino de nuestra propiedad.
Ahora, ¿qué ocurre con los contratos energéticos durante el período en que el inquilino se encuentra en nuestra propiedad sin pagar alquiler, o sea, cuando tenemos un piso de alquiler con morosos? ¿Acaso podemos cambiar la potencia contratada o dar de baja el servicio como forma de presionar su salida de la propiedad? Vamos a averiguarlo juntos en los siguientes apartados.
¿Podemos cambiar la potencia contratada cuando tenemos un piso de alquiler con morosos?
Cambiar la potencia contratada con Endesa, Holaluz o Podo al mínimo ofrecido es una decisión inteligente cuando nuestro objetivo es fomentar el ahorro económico a través de la reducción del coste de la factura energética.
En este aspecto, es importante recordar que mientras menor sea la potencia contratada, más económica será la parte fija de la tarifa.
Sin embargo, como la energía es considerada un bien esencial para el desenvolvimiento de la vida diaria, solamente podremos cambiar la potencia contratada si esta decisión no afecta el acceso al servicio vital de los inquilinos en nuestra propiedad. ¿Qué mecanismos conciliatorios y legales tenemos para gestionar los contratos de alquiler cuando tenemos un inquilino moroso?
Que no podamos dar de baja la luz no significa que no podamos tomar acciones conciliatorias, legales e incluso judiciales para incentivar a que el inquilino abone la deuda pendiente y, en última instancia, abandone nuestra propiedad sin generar ningún daño.
Veamos, pues, cuales son algunas de estas acciones a continuación:
- El primer paso cuando tenemos un piso de alquiler con morosos siempre será el proceso conciliatorio. En caso de que exista un leve retraso en el pago del alquiler, lo mejor es hablar con los inquilinos para determinar si se trata de pequeño desliz y así acordar nuevas fechas o cuotas de pago sin llegar al punto del desalojo.
- En caso de que el inquilino haya incurrido en un incumplimiento crónico del pago de la renta, podremos comenzar a explorar acciones legales en su contra. En este aspecto, tendremos que solicitar a un abogado que redacte un documento legal donde se estipule la fecha máxima de pago antes de iniciar acciones judiciales.
- En caso que el inquilino haya decidido ignorar el proceso conciliatorio y el documento legal solicitando el pago de las rentas pendientes, el propietario puede interponer una demanda como forma de lograr, a través de las autoridades competentes, el desalojo inmediato del inquilino de la propiedad.
